Terms of Service — MyBreederLine

§ 1. General

1. These Terms govern the use of MyBreederLine, a SaaS product for pedigree cat breeders (the Service).
2. The Service is a web app (including browser PWA) for herd management: cats, matings, pregnancy, litters, weights, and related features described in the product and on the pricing page.
3. Using the Service requires acceptance of these Terms and the Privacy Policy. Acceptance is confirmed at registration.
4. The Service is multi-tenant cloud software: each breeder’s data is logically separated by user identity and database access policies.

§ 2. Definitions

1. Provider: Wojciech Derda, correspondence address: ul. Orla 47 m 21, 75-727 Koszalin, Poland.
2. Until a formal business registration is required/completed, the Provider may not hold a VAT ID (NIP) / CEIDG entry — this document will be updated if that changes.

§ 4. Contract and Account

1. The contract is formed when an Account is created and the Terms and Privacy Policy are accepted.
2. The User must provide accurate registration data and be entitled to enter into the contract.
3. The User is responsible for login confidentiality. Suspected unauthorized access must be reported to support@mybreederline.pl.
4. The Provider may refuse, suspend or terminate Accounts for Terms violations, abuse, or legal requirements.

§ 5. Scope of the Service

1. The Service may include herd records, mating/pregnancy tracking, litters/kittens, weight logs, soft reminders/dashboard items, and Pro billing via Stripe.
2. Public tools (e.g. pregnancy calculator) may be available without an Account as shown on the site.
3. The Service does not replace veterinary advice, registry decisions (e.g. FIFe), or the breeder’s legal duties toward kitten buyers.
4. Availability depends on cloud providers. The Provider aims for high availability but does not guarantee uninterrupted 24/7 uptime.

§ 6. Free and Pro plans

1. Details: Pricing. Currency follows locale (PLN for PL, EUR for EN) unless Stripe/product config states otherwise.
2. No card trial — Free remains available with the litter limit; Pro requires an active Subscription.
3. After Pro cancellation, Free limits apply when the paid period ends (per Stripe). Breeding data is not deleted solely because a Subscription ends.
4. Price changes for existing Subscriptions require at least 30 days’ notice, except User-driven changes or tax-driven updates.

§ 7. Payments (Stripe)

1. Pro payments are processed by Stripe. The Provider does not store full card numbers.
2. Checkout and subscription management use Stripe Checkout / Customer Portal (or equivalent in-product flows).
3. Failed payments may be retried (`past_due`). Persistent failure may suspend/cancel the Subscription and revert the Account to Free limits.
4. Renewals are automatic until cancelled by the User in the billing portal.

§ 8. Withdrawal and refunds (consumers)

1. If the User is a consumer, mandatory consumer-protection rights apply under applicable law.
2. For digital services/content, starting performance after explicit consent may affect withdrawal rights — details are shown at Checkout where applicable.
3. Refund/billing requests: support@mybreederline.pl (and Stripe where the dispute concerns payment processing).

§ 9. User content and duties

1. The User enters Breeding data on their own responsibility and confirms they are entitled to process it.
2. Prohibited: circumventing limits/security, attacking infrastructure, malware, unlawful use, abusive multi-accounting.
3. The Provider may remove unlawful content and restrict Accounts.

§ 10. Provider liability

1. The Provider delivers the Service with due care.
2. To the fullest extent permitted by law, liability to non-consumers is limited to direct damages and to fees paid for the Service in the 12 months before the event.
3. The Provider is not liable for breeding decisions, User-entered content, or third-party outages except for intentional misconduct.

§ 12. Changes

1. The Provider may update these Terms for legal, security, product or pricing reasons.
2. Material changes will be announced in the Service and/or by email with reasonable notice.
3. Continued use may require re-acceptance when required by law or the nature of the change.

§ 13. Governing law

1. Polish law applies, subject to mandatory consumer protections.
2. Consumers may also use applicable out-of-court procedures (e.g. EU ODR) where available.
3. For B2B disputes, courts competent for the Provider’s place of residence apply unless mandatory rules say otherwise.

§ 14. Final provisions

1. If any clause is invalid, the remaining clauses stay in force.
